* Customers must provide safe, clean and clear access. Food trucks can be tricky but are possible.

** Out of qualification tank recycling surcharge of $5.00 applies to any 20lbs tanks, $30.00 for any 30lbs, 40lbs and 100lbs tanks with a date stamp showing less than one year left qualification at the time of delivery. If the tank must be completely recycled the customer will be responsible for paying the additional amount to sell them a new or replacement tank. Also, we won't charge you for any tank you got from us that expires or charge you for a recertification we did for you that expires.
*** If you bring your expired tank to us we can give it a recertification sticker for $20 if it passes our inspection test. These recertification stickers will give your tank five more years of use and this can be done up to three times.

The Propane Guys – Taking the pain out of getting Propane!

We're happy you've chosen The Propane Guys to deliver propane to you. This is the new, easy way to get propane.  Welcome to the club! 

The Propane Guys will deliver propane to you (as requested) wherever you tell us to deliver it via our website order form. (You'll provide us with an email to communicate with you. We keep this email private-we hate spam too). We don't hook the tank up to of your devices – it is not allowed by law, and it opens us up to liability we cannot accept and that you do not want to have to pay for. We also can’t monitor propane tank levels. We just swap out the empty tank in the location requested with a full tank when you ask us to do so and on the date promised. It's kind of like the milkman of propane. If you don't have a tank for the first delivery, then we'll provide the new tank for you. If you have your own tank, then we'll take that tank and give you a full tank. It doesn’t matter if it says Blue Rhino, AmeriGas, or nothing on it at all.  We can swap all tanks that are up to snuff.  If your tank is not up to snuff (or is older than 10 years from original cert, or 3 from a recert) we charge a simple $5.00 re-certification and recycling fee to get it back into circulation, or to dispose of it properly.  Pretty simple.

We expect payment for deliveries within thirty (30) days and I am sure you would expect the same.  Please don’t make us chase you down.  That’s not fun.  If you are dissatisfied with The Propane Guys' service or the materials available on its website, your sole and exclusive remedy is to discontinue using The Propane Guys service. Just let us know.  

Liability (not-so-fun stuff) but very rare……
The party who is at fault pays for financial losses related to this agreement proportionate to its share of fault. Sometimes the law tries to tag the party who is not at fault with the negligence of the person who is at fault (the legal term for this is vicarious liability). If this happens (and it shouldn't because Alaska doesn't have vicarious liability), the party who is at fault will make the party who is not at fault whole for this financial loss proportionate to the party-at-fault's share of fault. 

It's often not clear who is at fault when legal action is made. A party could incur sizeable costs to prove that they are not at fault. If a party believes that they don't have any fault in the matter, they shall promptly tender the claim to the party who they believe is at fault. If that other party doesn't accept the tender and the tendering party is ultimately found not at fault or its share of fault is less than alleged, then the party who is found at fault will pay all of the tendering party's attorney's fees and costs proportionate to the tendered party's share of fault.

Arbitration (really not-so-fun stuff) but even more rare.......
We really hope there aren't any disputes. We strive to treat everyone with fairness. If there is a disagreement, let's try to work things out over the phone or through correspondence. If we can't resolve things this way, then binding arbitration is the exclusive means of resolving any dispute related to this agreement, including tort claims. Alaska's Revised Uniform Arbitration Act (AS §09.43.300 to .595) and all subsequent arbitration statutes govern the arbitration proceedings. The arbitration proceedings are to take place in Anchorage, Alaska.

A party shall initiate arbitration by sending a notice to the other party describing the controversy and remedy sought and providing a list of five arbitrators listed in the Alternative Dispute Resolution section of the most recent edition of the Alaska Directory of Attorneys published by Todd Communications or its successor. The initiating party shall serve this notice with the list of arbitrators under the notice provision in this agreement.

The party receiving the notice shall give notice of its selection of an arbitrator from the list of arbitrators within 10 days of receiving the notice. If the receiving party fails to select an arbitrator within that timeframe, then the initiating party shall choose the arbitrator from the list. The party who does not prevail in the arbitration shall pay all of the prevailing party's actual attorney's fees and costs related to the arbitration. The parties shall give all notices required in this agreement to the addresses specified above as follows (deemed received as specified in parentheses): by hand (upon delivery), via overnight FedEx or UPS (24 hours after deposit), by email (with email confirmation from recipient), or by first class certified or registered mail, return receipt requested, postage prepaid (48 hours after deposit in the mail).

Miscellanous (yeah, we can change things, if needed......)
The Propane Guys LLC reserve the right to modify this agreement at any time without prior notice, and such modification shall be effective immediately upon posting on The Propane Guys' website. It is your responsibility to review this agreement periodically and make yourself aware of any modifications. Your continued use of The Propane Guys delivery service will be deemed to be your conclusive acceptance of the modified Agreement. Alaska law controls this agreement. This is the whole agreement and there aren't any other agreements.
